copyright

The first type of intellectual property that RHINOSHIELD will discuss is the one that is most relevant to business operations and everyday life: copyright.

Copyright means the right to own copyrighted works that are created and protected by the Copyright Act. trademark

Trademarks are a type of intellectual property that plays an important role in business. Having a trademark is essential for any business or undertaking, whether it is selling goods, providing services, or hiring. Trademarks serve to identify the identity of that business or undertaking, allowing consumers to clearly distinguish your business from other businesses. In addition, trademarks, whether registered under the Trademark Act or not, are still important in building credibility and creating a unique image for the business.

This type of intellectual property rights is important for businesses related to design, research, development and product development. Patents are an important tool to protect works related to invention and design, which are protected by the Patent Act. They can be divided into the following types of patents:

  1. Invention Patent: Protects the development of new products or processes with higher inventive steps, such as inventing new technologies or production methods.

  2. Product Design Patent : Protects the design of the shape, pattern, color, or external elements of a product or a new product creation that makes the product have a distinctive and different appearance from other products.

  3. Patent : Protects the development of new products or processes that are creative but not as complex as an invention patent.

Other intellectual property

In addition to the three types of intellectual property rights mentioned above, there are other types of intellectual property rights that are protected by law, which are also important for business purposes. Other types of intellectual property are as follows:

Trade secrets

Trade secrets are information that has commercial value and is not yet known or generally accessible. These information is discovered, invented, compiled or created and is kept secret under the Trade Secrets Act. Examples include food recipes, drink recipes, processes, techniques and know-how used in manufacturing or business operations.

Integrated circuit diagram

It refers to the complex design of an integrated circuit (IC) such as a processor, memory, and motherboard. This protection covers the layout and interconnection of the circuit under the Integrated Circuit Layout Protection Act. The protection of integrated circuit layouts is important for developers and manufacturers in the electronics industry to prevent unauthorized copying or use.

Before registering a copyright, let's take a look at the criteria for consideration first.

For creators who want to register copyright for their own creative works, whether it be writing, pattern design, artwork, etc., do you know that in order to register, your work must meet the criteria for copyright registration? The work that will be registered must meet the following criteria for consideration:

It is a work that expresses ideas (Expression of Idea).

Originality

Sweat & Labour and Judment

It falls into the categories of works recognized by copyright law.

The work must not violate the law and good morals.

If your work meets all of these criteria, you can prepare to gather all the documents to register the copyright. You can do this by applying in person at the Department of Intellectual Property, Ministry of Commerce, or by filing the copyright online at the website of the Department of Intellectual Property.

What is Copyright Trading / “Transfer of Intellectual Property Rights”?

When a creator has successfully registered their work for copyright, but one day a person or company is interested in the creator's work and wants the rights to that intellectually copyrighted work, the creator can also buy and sell the copyright of that work.

By assignment of intellectual property rights or intellectual property rights transfer, it means a process in which the assignor, such as the owner of intellectual property or right holder, transfers the ownership rights in that intellectual property absolutely to the assignee, which may be another person or legal entity who will become the new owner or right holder. This assignment of rights can occur in the following cases:

Transfer of intellectual property rights for compensation

It is the transfer of ownership rights in intellectual property in which the transferor receives compensation from the transferee. This process often occurs in the form of a sale of intellectual property rights, in which the full rights to use, control, and benefit from the property are transferred to the transferee.

Transfer of intellectual property rights without compensation

It is the transfer of intellectual property rights without any exchange of compensation, such as giving or granting the right to own intellectual property. This process often occurs in situations where the transferor wants to give the rights to the transferee with the intention of donation or other reasons not related to making a profit.

The assignment of intellectual property rights or the sale of copyrights, whether with or without consideration, results in a change of ownership of the intellectual property, giving the assignee full rights to the intellectual property and the ability to use, control and benefit from it. At the same time, the assignor terminates all rights he or she previously had in the intellectual property.

Therefore, before making any trade or transfer of intellectual property rights, creators should thoroughly and clearly study and make an agreement with the transferee in order to receive the best benefits and prevent being cheated by ill-intended people.

The benefits of intellectual property rights for creators

Many people who have read up to this point may still be wondering what are the benefits of having intellectual property rights registered for the work we have created, whether it be designs, drawings, writings, or images. RHINOSHIELD has compiled the benefits of having intellectual property rights to make creators aware of the importance of this.

It helps to ensure fairness to creators, especially if someone wants to use the work, they must ask for permission and pay the owner for the work.

It is recorded and registered in the system as evidence to confirm who is the real owner of the work, so the idea cannot be easily stolen.

Help preserve the rights of the owner of the work even if it is used abroad.

It is like a reward for your dedication and determination in creating your work.

Help the creators to be motivated to continue creating good works.

Stimulate people to be creative and try to invent new things.

If creators want to inquire for more information about intellectual property rights, they can go in person at the Department of Intellectual Property. Or if it is inconvenient to go in person, you can also call the Department of Intellectual Property hotline at 1368.
